INTRODUCING THE VIAC RULES OF ARBITRATION 2026

The VIAC Rules 2026 enters into force from 1 July 2026 and shall apply to the arbitral proceedings commenced on or after 1 July 2026, unless otherwise agreed by the parties.

Arbitral proceedings pending before VIAC under the Rules of Arbitration in effect as of 1 March 2017 (the "VIAC Rules 2017") shall continue to be governed by the VIAC Rules 2017.

CONFERENCE ON “THE 2025 LAW ON CONSTRUCTION – KEY CONSIDERATIONS IN CONSTRUCTION CONTRACTS AND LEGAL RISK MANAGEMENT”

On 10 December 2025, the 2025 Law on Construction (Amendment) was adopted and officially came into effect on 1 July 2026, marking a significant milestone in the legal framework governing construction investment activities in Viet Nam, particularly on administrative procedures, strengthens accountability for ensuring construction quality and project management. Against this backdrop, in January 2026, VIAC, in collaboration with the Society of Construction Law of Vietnam (SCLVN) and academic institutions, organised a seminar entitled “The 2025 Law on Construction – Key Considerations for Construction Contracts and Legal Risk Management” in Hanoi and Ho Chi Minh City.

The seminar attracted more than 300 participants, including representatives from state management agencies, business associations, enterprises, legal professionals, and lawyers in Hanoi and surrounding localities. Notably, the programme featured contributions from 13 experts in Hanoi and 20 experts in Ho Chi Minh City in the fields of construction and law, including representatives from VIAC’s leadership, the Department of Construction Economics and Investment Management (Ministry of Construction), the Institute of Construction Economics, Hanoi Law University, SCLVN, as well as representatives from law firms and professional consulting organisations.

ARBITRATION - MEDIATION SYMPOSIUM 2026 (AMS 2026): SERIAL DISPUTES - TRENDS, PRACTICES AND EMERGING ISSUES

In light of changes in market structures and transaction models, serial disputes are increasingly becoming prevalent. Unlike single disputes, serial disputes pose greater challenges to the management of arbitral proceedings. This requires arbitral tribunals, institutions, and the disputing parties to adopt a broader perspective and conduct an overall assessment, thereby developing a systematic and consistent dispute-management process. It helps to effectively control arising issues in the course of resolving multiple disputes that share the same nature and legal issues.

Thus, VIAC, in collaboration with law training institutions, continued to implement the Arbitration - Mediation Symposium (abbreviated as the “AMS”). In nearly one month of organisation, AMS 2026 attracted 600 participants and featured more than 11 leading experts in arbitration and mediation at each seminar, including lawyers, arbitrators, academics, representatives from major law training institutions, and the business community. AMS 2026 was simultaneously organised in Hanoi and Ho Chi Minh City, with enhanced investment in both scale and quality. [See more]

HO CHI MINH CITY INTERNATIONAL CONSTRUCTION ARBITRATION CONFERENCE 2026 (HICAC 2026)

As Vietnam continues to experience significant growth in construction activities, Ho Chi Minh City International Construction Arbitration Conference 2026 (HICAC2026) - held by VIAC and SCLVN, provides a timely platform for stakeholders to exchange knowledge and insights on the challenges and opportunities facing the construction arbitration landscape in Vietnam and beyond.

The conference held successfully on 9–10 April 2026, brought together 42 international and domestic speakers. The event attracted 314 participants, including lawyers, arbitrators, industry experts, and academics, and featured in-depth discussions on infrastructure dispute resolution, while providing a platform to exchange insights on the latest trends, practices, and developments in construction arbitration. VIETNAM ADR WEEK 2026 (VAW 2026)

In the context of increasingly expanding and complex trade and investment activities, the demand for effective, transparent, and reliable dispute resolution mechanisms has become more pressing than ever. Deepening economic integration not only increases the volume of cross-border transactions but also calls for the continuous refinement of the legal framework, as well as the enhancement of the quality and practical effectiveness of dispute resolution methods in line with modern business realities. In this context, the establishment of a specialized, multidimensional, and well-connected forum to promote dialogue, share experiences, and strengthen cooperation in arbitration, mediation, and other ADR mechanisms has become particularly essential.

In this spirit, the Vietnam ADR Week 2026 (VAW 2026), themed “Arbitration & ADR: Embracing New Heights”, is organized as a series of professional and networking events by the Vietnam International Arbitration Centre (VIAC) in collaboration with the Vietnam Lawyers' Association. Held over five days, from 25 to 29 May 2026, in Hanoi and Ho Chi Minh City, the event attracted more than 1,500 participants, brought together over 80 domestic and international experts, and engaged more than 60 partner organizations from Vietnam and abroad. THE 4TH HO CHI MINH CITY LEGAL MANAGEMENT SERIES 2026 (LMS 2026)

Driven by the global digital transformation, traditional methods of contract formation and performance are increasingly being replaced by transactions incorporating electronic elements, smart contracts, and digital data management... This transformation provides businesses with greater flexibility to optimise processes, reduce costs, and expand opportunities for collaboration, particularly in cross-border transactions. However, alongside these opportunities, the adoption of electronic transactions also gives rise to new risks, presenting significant challenges for businesses in contract management and dispute resolution.

In response to the evolving needs of the business community and the growing complexity of commercial disputes, the Vietnam International Arbitration Centre (VIAC), in collaboration with the Ho Chi Minh City Investment and Trade Promotion Centre (ITPC), is organizing the 4th Ho Chi Minh City Legal Management Series (LMS 2026) under the theme “Redefining Transactions in the Digital Era”. VIETNAM INTERNATIONAL MOOT COURT COMPETITION (VIMCC) 2026

The Vietnam International Moot Court Competition (VIMCC) 2026 is a moot court competition taking place from July to September 2026 in Hanoi, bringing together Vietnamese and international law students with an interest in advocacy and dispute resolution.

VIAC joins VIMCC 2026 as a co-organiser and the competition's professional sponsor. VIMCC 2026 is expected to continue providing high-quality academic experiences, contributing to the development of a new generation of legal professionals equipped to integrate into and meet the demands of the global legal environment. HIGHLIGHT EVENTS

GENERAL SECRETARY AND PRESIDENT TÔ LÂM WITNESSES THE EXCHANGE OF MEMORANDUM OF UNDERSTANDING BETWEEN VIAC AND THE INDIA INTERNATIONAL ARBITRATION CENTRE (IIAC)

On the afternoon of 7 May 2026, within the framework of the official visit to India, General Secretary and President Tô Lâm, together with Chief Minister of Maharashtra Shri Devendra Fadnavis, witnessed the exchange of a Memorandum of Understanding (MoU) between the VIAC and the India International Arbitration Centre (IIAC).

The signing of the MoU between VIAC and IIAC marks an important milestone, demonstrating the shared commitment of both institutions to promoting arbitration and ADR as effective mechanisms for resolving international commercial disputes, thereby fostering confidence among businesses and investors engaged in cross-border trade. Furthermore, witnessed directly by senior leaders of both countries, this cooperation also carries broader significance, contributing to the promotion and practical realisation of the Vietnam-India Strategic Partnership. ASSOC. PROF. DR. PHAM DUY NGHIA OFFICIALLY BECAME THE NEW VICE PRESIDENT OF THE VIETNAM INTERNATIONAL ARBITRATION CENTRE (VIAC)

On March 3, 2026, Assoc. Prof. Dr. Pham Duy Nghia officially became the new Vice President of VIAC. Assoc. Prof. Dr. Pham Duy Nghia has worked at VIAC as an Arbitrator since 2002 and has made numerous active contributions to the development of VIAC. Currently, alongside his role as Vice President of VIAC, Assoc. Prof. Dr. Pham Duy Nghia also holds the positions of Chairman of the VIAC Science Council and Director of the Vietnam Institute for Arbitration Research and Training (VIART). [See more]

MEDIATOR NGUYEN THI MAI APPOINTED AS DIRECTOR OF THE VIETNAM MEDIATION CENTRE (VMC)

On 21 May 2026, Mediator Nguyen Thi Mai assumed the position of Director of the Vietnam Mediation Centre (VMC), operating under VIAC. Mediator Nguyen Thi Mai is currently a VMC Mediator and a VIAC listed Arbitrator. With extensive expertise in mediation, arbitration, and commercial business law, Ms. Mai is among the highly experienced professionals who have made significant contributions to the promotion and development of out-of-court dispute resolution mechanisms in Vietnam. 2026 VIAC’S ARBITRATORS AND MEDIATORS MEETING IN HANOI AND HO CHI MINH CITY

On March 21 and March 28, 2026, VIAC successfully organized the 2026 Meeting with Arbitrators and Mediators in Hanoi and Ho Chi Minh City. The event aimed to connect participants, while also presented VIAC’s 2025 Annual Activity Report.

Attending Arbitrators and Mediators highly praised and congratulated VIAC on its positive achievements in 2025. In addition, numerous constructive recommendations were put forward, focusing on the continued refinement of arbitration rules as well as the draft Law on Commercial Arbitration to expand the scope of activities for both VIAC and the arbitration mechanism as a whole. VIAC AND VIART ORGANIZE TRAINING COURSE ON DISPUTE RESOLUTION BY ARBITRATION – INTERMEDIATE MODULE 2 IN HANOI AND HO CHI MINH CITY

From 17 to 19 April 2026 in Hanoi and from 8 to 10 May 2026 in Ho Chi Minh City, the Vietnam Institute for Arbitration Research and Training (VIART), under the Vietnam International Arbitration Centre (VIAC), successfully organized the Training Course on Dispute Resolution by Arbitration – Intermediate Module 2 (INTER2.0126).

With a training approach that integrates theory with practice, the programme not only helped participants consolidate their knowledge of arbitration law and practice but also provided opportunities to develop strategic thinking, advocacy, case management, and arbitration proceedings skills in a simulated environment closely reflecting actual professional practice. The two-way interaction between lecturers and participants further facilitated the exchange of practical experience, thereby enhancing learning outcomes and participants’ ability to apply their knowledge in their professional work. 

VIAC AND AUSCHAM CO-ORGANIZE THE AUSCHAM–VIAC WEBINAR SERIES 2026

To share knowledge and practical perspectives on legal and business issues, VIAC, in collaboration with the Australian Chamber of Commerce Vietnam (AusCham), organized the AusCham–VIAC Webinar Series 2026, featuring the participation of experts from Vietnam and abroad.

Kickstarting the series, Webinar #01: “Vietnam’s Real Estate Reset: Navigating the New Legal Landscape”  focused on major updates in Vietnam's real estate legal framework, attracting more than 250 participants from businesses, investors, and the legal community.

Following that, Webinar #02: “Green Finance in Vietnam: Legal Framework, Risk and Practical Access for Businesses” provided practical insights into green finance and opportunities for businesses to access sustainable funding sources, with the participation of 120 delegates from regulatory authorities, financial institutions, businesses, investors, and the legal community.

The next 02 webinars are held in July and August of 2026. Webinar #03: “AI, Digital Transformation and Cyber Resilience: What Businesses in Vietnam Should Prepare For?” was successfully organized on 23 July, bringing together 100 participants and focusing on legal issues, cybersecurity, and business resilience in AI application and digital transformation. Webinar #04: “Vietnam’s New Labour and Social Insurance Regulations: Compliance, Cost, and Risk Management” is scheduled for 27 August, focusing on updates to labour and social insurance regulations, as well as compliance requirements and risk management for businesses.

“BUSINESS TALK” SERIES ORGANIZED BY THE SMALL AND MEDIUM ENTERPRISE SUPPORT CENTRE (VCCI SMEs)

The “Business Talk” series, organized by the Small and Medium Enterprise Support Centre (VCCI SMEs) with the support of VIAC, is held regularly to provide businesses with updates on legal regulations, new policies, and practical issues affecting their production and business activities.

In 2026, the series featured four sessions covering the following topics: “U.S. Reciprocal Tariffs: Impacts and Recommendations for Vietnamese Businesses” (January 2026); “Tax Management for Business Households: Impacts of New Policies and Recommendations for the Transition Process” (March 2026); “Online Business Operations: New Regulations under the 2025 Law on E-Commerce” (April 2026); and “Implementing Traceability Systems for Effective Market Access” (June 2026). Through the participation of experts in various fields, the programmes provided practical insights, analysis, and recommendations to help businesses strengthen compliance capacity, manage risks, and adapt to changes in the business environment. 

VIAC’S LISTED ARBITRATORS RECOGNISED IN THE A-LIST 2025: VIETNAM’S TOP 100 LAWYERS

 

Asia Business Law Journal recently conducted research and announced the list of Vietnam's Top 100 Lawyers in 2025. Notably, this ranking recognizes the presence of 21 Listed Arbitrators of VIAC and Listed Mediators of VMC, operating under VIAC. To identify the top 100 Lawyers in Vietnam, the Journal surveyed in-house counsels and corporate legal experts both in Vietnam and internationally, as well as partners at international law firms, seeking their nominations for lawyers who merit inclusion in this list.

The distinguished individuals acknowledged not only possess a robust professional reputation and extensive legal expertise but are also highly regarded for their incisive analytical skills and comprehensive strategic vision. SEMINAR ON “IDENTIFYING AND RESOLVING BUSINESS DISPUTES IN THE NEW ERA” AND THE SIGNING CEREMONY OF THE COOPERATION AGREEMENT BETWEEN VIAC AND THE UNIVERSITY OF ECONOMICS – THE UNIVERSITY OF DANANG (DUE)

To strengthen the connection between academia and practice, on 26 June, VIAC, in collaboration with the University of Economics – The University of Danang (DUE), organised a Seminar on the topic “Identifying and Resolving Business Disputes in the New Era.”

Within the framework of the programme, VIAC and DUE conducted the signing ceremony of a Memorandum of Understanding (MoU) on cooperation, with the participation of Prof. Dr. Le Hong Hanh – President of VIAC; Assoc. Prof. Dr. Doan Ngoc Phi Anh – Vice Rector of DUE, along with numerous experts, academics, lawyers, and representatives from legal institutions and organisations. [See more]

VIAC CO-ORANISED TRAINING COURSE: “SKILLS FOR OUT-OF-COURT DISPUTE RESOLUTION IN FINANCE – BANKING SECTOR” WITH VNBA

On May 30 in Ho Chi Minh City and June 06 in Hanoi, VIAC, in collaboration with Vietnam Banking Association (VNBA), successfully organized two training courses for businesses titled “Skills for Out-of-Court Dispute Resolution in Finance – Banking Sector”. The event attracted more than 200 legal and debt recovery specialists from banks and credit institutions, creating a practical professional forum to discuss alternative dispute resolution (ADR) mechanisms in the financial and banking sector. PRIME TRAINING PROGRAMME: LEGAL MANAGEMENT MINDSET AND SKILLS FOR BUSINESSES

In the context of an increasingly complex business environment, corporate decisions are influenced by various factors, including legal frameworks and compliance requirements. In response to this practical need, the PRIME Training Programme on Proactive Risk-integrated Mindset for Executives, designed to support businesses in developing proactive legal management strategies and skills, was jointly developed and successfully implemented by VIAC and the Vietnam Chamber of Commerce and Industry – Ho Chi Minh City Branch (VCCI-HCM).

Held on Fridays throughout May 2026, the PRIME 2026 training programme attracted participants from corporate legal departments, in-house counsel, legal consultants, and business leaders. The programme consisted of four thematic sessions focusing on practical legal issues commonly encountered by businesses. [See more] 

SPECIALIZED TRAINING CONFERENCE ON “RISK MANAGEMENT IN BIDDING, COMMERCIAL DISPUTE RESOLUTION, AND UPDATES ON NEW TAX POLICIES IN 2026”

On the morning of April 14, 2026, in Ha Tinh, VIAC with the Department of Justice of Ha Tinh Province and the Tax Department of Ha Tinh Province, organized a specialized training conference titled “Risk Management in Bidding, Commercial Dispute Resolution, and Updates on New Tax Policies in 2026.” The conference was attended by over 200 delegates, including legal officers, contract and bidding advisory staff from various departments and agencies, representatives of enterprises, cooperatives, credit institutions, banks, and law practice organizations in the province.

Given the limited legal capacity, the Conference was organized in order to equip delegates with practical knowledge and skills in legal risk management, enhance compliance efficiency, and proactively prevent disputes in production and business activities. This is also a practical activity contributing to the orientation of building a transparent, stable, and sustainable investment environment in the province. [See more]

FORUM ON "LEGAL RISK MANAGEMENT, DISPUTE PREVENTION AND RESOLUTION FOR INVESTMENT AND BUSINESS IN THE DIGITAL ERA"

On the morning of April 17, 2026, VIACi, in collaboration with the Vietnam Chamber of Commerce and Industry (VCCI) - Central-Tay Nguyen Branch and VCCI Intellectual Property Company Limited, organized a Forum titled “Legal Risk Management and Dispute Prevention and Resolution in Investment and Business Activities in the Digital Age” in Da Nang City.

Aiming to assist businesses in enhancing legal risk management capabilities, strengthening compliance, and effectively utilizing suitable dispute resolution methods, the forum has provided practical knowledge and insights. Featuring representatives from state agencies and corporate leaders, the event received overwhelming positive feedback, creating a highly practical and engaging platform for businesses to sharpen their skills and experience in dispute prevention and resolution. VIAC WELCOMES AND HOLDS WORKING SESSIONS WITH DOMESTIC AND FOREIGN AGENCIES AND ORGANIZATIONS

During the first six months of 2026, VIAC actively promoted its external relations by hosting and working with numerous prestigious domestic and international agencies, organizations, and partners. These engagements served to enhance professional exchanges, strengthen cooperative ties, and expand networking channels, thereby further elevating the standing of Vietnamese commercial arbitration on the international stage.

Regarding domestic partners, VIAC intensified a series of cooperative activities through key strategic meetings. Specifically, on the afternoon of April 15, 2026, VIAC met with the University of Economics – The University of Danang to explore potential collaboration between the two institutions. Following this, on the morning of June 10, 2026, VIAC engaged in discussions with the Vietnam Banks Association (VNBA) on promoting arbitration and mediation methods in the banking and financial sector. On June 14, 2026, VIAC partnered with the Vietnam Lawyers Association and VCCI Central - Tay Nguyen Branch to work with the Vietnam International Financial Center in Da Nang (VIFC-DN), aiming to contribute to building a complete legal ecosystem for the center.

Regarding foreign agencies and organizations, VIAC actively fostered international cooperation by receiving high-level delegations and esteemed global partners. Key exchanges included working meetings with representatives from eBRAM International Online Dispute Resolution Centre (April 6, 2026); a delegation from Guangdong Province, China, led by Ms. Gujie Yuan, Secretary of the Political and Legal Affairs Commission of the Provincial Party Committee (April 21, 2026); a delegation from the Ambassador Extraordinary and Plenipotentiary of the Swiss Confederation led by Ambassador Thomas Gass (June 1, 2026); and a delegation from the Department of Justice of Shaanxi Province, China, led by Director General Yang Zhengguo (June 24, 2026), to discuss and unlock strategic collaboration opportunities between the parties.

MEMORANDUM OF UNDETSTANDING (MOU) SIGNING CEREMONY BETWEEN VIETNAM INTERNATIONAL ARBITRATION CENTRE (VIAC) AND FPT UNIVERSITY (FPTU) & TALKSHOW TITLED “ALTERNATIVE DISPUTE RESOLUTIONS (ADR) IN PRACTICE AT VIAC: SKILL SET AND CAREER OPPORTUNITIES”

On the morning of March 20, 2026, Memorandum of Understanding (MoU) Signing Ceremony between VIAC and FPT University (FPTU) took place at FPTU, with the participation of Prof. Dr. Le Hong Hanh – President of VIAC and Dr. Nguyen Kim Anh – Vice President of FPTU, in the presence of the two parties’ representatives

After the Signing Ceremony, Talkshow “Alternative Dispute Resolutions (ADR) in practice at VIAC: Skill Set and Career Opportunities”, marked the beginning for the series of academic collaboration activities between two parties. Through the talkshow, the speakers shared practical insights into VIAC's operations, dispute resolution procedures, as well as career opportunities and essential skills for students. This was not only a chance to expand their knowledge but also a valuable opportunity to help students better define their future career paths. [See more]

LAWYER NGO KHAC LE: “THE NCD CONVENTION IS ONE OF THE RARE LEGAL INSTRUMENTS DESIGNED TO KEEP PACE WITH COMMERCIAL PRACTICE RATHER THAN BE LEFT BEHIND BY IT.”

On 15 December 2025, the United Nations General Assembly adopted the United Nations Convention on Negotiable Cargo Documents (NCD), also known as the Accra Convention, marking a significant step towards strengthening the legal framework for global trade in the context of increasingly digitalised and multimodal supply chains.

According to Lawyer Ngô Khắc Lễ, the NCD Convention is a highly practical legal instrument that addresses longstanding gaps concerning the legal recognition and transferability of cargo documents in international trade. For Vietnam, studying, signing and ratifying the NCD Convention carries strategic importance in promoting digital transformation, facilitating trade finance and enhancing the competitiveness of Vietnamese businesses. ANNUAL REPORT 2025

The Vietnam International Arbitration Centre (VIAC) is pleased to introduce the VIAC Annual Report 2025 - a publication highlighting dispute resolution activities through arbitration and mediation, as well as VIAC’s key milestones in domestic and international cooperation, and initiatives directed toward the business and ADR communities throughout 2025.

This publication reflects the significant achievements attained by VIAC in contributing to a more transparent and efficient business environment in Vietnam over the past year. At the same time, it conveys VIAC’s aspirations and objectives for 2026 - a year marked by major orientations, bold steps, and decisive actions in response to emerging opportunities.

Attended by nearly 300 participants, including construction and legal experts, representatives of state management agencies, business associations, enterprises, legal professionals, and lawyers from Hanoi and neighbouring localities, the conference provided a platform for in-depth discussions on the key amendments introduced by the revised Law on Construction, as well as the practical challenges associated with the negotiation, performance, and legal risk management of construction contracts.

EVENT MATERIALS FOR THE VIETNAM ADR WEEK 2026 (VAW 2026)

Vietnam ADR Week 2026 (VAW 2026) held from 25 to 29 May 2026 in Hanoi and Ho Chi Minh City, brought together representatives of government authorities, legal experts, arbitrators, and the domestic and international business communities.           

Featuring 05 main events, VAW 2026 focused on in-depth discussions on the protection of property rights and the freedom to conduct business. The event also officially launched the VIAC Arbitration Rules 2026, providing businesses with a transparent, flexible, and cost-effective dispute resolution mechanism.
